Is my business eligible to participate in the sponsorship of a skilled worker?

Employers may have already identified an area of their business that they believe could benefit from the employment of a skilled worker. This is the first step to determine the course of action to take to address their skills shortage.

There are a few determining factors that will give you an indication of your eligibility to participate.

Employers within this program must be approved by the Australian Government as a “Temporary Activities” sponsor. To be eligible to apply for sponsorship, your organisation will need to meet the following requirements:

  • Your organisation must be operating lawfully in Australia or be a government agency or foreign government agency.
  • You need to have an impeccable reputation for conducting business within the bounds of the law. Your application and the persons noted in it and responsible for it must be “fit and proper” persons themselves.
  • You agree to maintain harmony with sponsorship obligations such as the provision of bank statements, profit and loss statements, tax returns of recent year/s, or other documents as requested as part of the process.
  • Provide and support appropriate occupational training – should it be required (this does not need to be accredited training).

 

What do I have to provide to become a sponsor?

This is the type of document checklist as an employer/sponsor that you will be expected to provide:

  • A copy of your Australian Business Number (ABN) Registration Certificate.
  • Business Name Extracts (If you have various Trading Names etc.)
  • A financial report that includes a profit and loss statement as well as a balance sheet.
  • Business Activity Statements (BAS) over the last four (4) quarters.
  • Organisational chart that shows the hierarchy of reporting and positions that are held.
  • Advertisements or Promotional material for your company.
  • Any evidence of new sales or contracts that your company has won.
  • Business expansion plans that show evidence of proposals for company growth.

 

On the other hand, employers are expected to provide the following documents for the nomination application:

  • Organisational Chart
  • Standard Employment Contract
  • Letter of support from your company Accountant
  • Meeting the requirements for AMSR (Market Salary Report)
  • Able to pay the SAF levy (Skilling Australians Fund)
  • Meet the LMT (Labour Market Testing) requirement
  • Genuine position report:
    • The occupation required for your business is in line with the ANZSCO description
    • The position fits in with your business requirements
    • Your business is viable to sponsor from overseas
    • You are able to provide independently verifiable evidence – this is documentation that will support your application as to why you are hiring additional staff. For example, copies of new contracts, purchase orders for new equipment, or paperwork or records that support the need for extra recruitment.
